FULLERTON, Calif. -- A California police department had no intent to deceive the public by releasing an old booking photo of a homeless man who died after a confrontation with officers or information about officers' potential injuries from the confrontation, an independent consultant said Tuesday.
However, the chief attorney for the Los Angeles Office of Independent Review recommended that the city of Fullerton draft a policy for releasing photos and make sure information is correct before releasing it.
"We found no evidence of intent by the Police Department to deceive or falsify," Michael Gennaco said during a packed City Council meeting as he gave an interim report on four issues related to the incident, which was partially recorded by bystanders' cellphone cameras.
Gennaco did not address the confrontation directly and said he aimed to report back about the struggle and Fullerton Police Department policies in April.
Police initially indicated that officers may have suffered broken bones in the July 5 confrontation with 37-year-old Kelly Thomas at a Fullerton transit hub. That turned out not to be the case, leading some people to question whether the department was trying to drum up sympathy, Gennaco said.
He also said the department should have consulted with Thomas' family before releasing an old booking photo that didn't portray him in a flattering light.
The city hired Gennaco after Thomas, who had been treated for schizophrenia, died following the struggle with six officers. Thomas died five days after the confrontation.
The Orange County district attorney's office filed charges last year against Officer Manuel Ramos, who has pleaded not guilty to second-degree murder and involuntary manslaughter, and Cpl. Jay Cicinelli, who has pleaded not guilty to involuntary manslaughter and excessive force.
Other issues addressed by Gennaco included the call for service that night by a woman who said a person she knew as "Kelly" was "roaming the parking lot" and "looking in cars" and "pulling on handles." He also said a search of a backpack carried by Thomas revealed mail, a passport and employee identification belonging to other people, but these items had been discarded and lost ? not stolen.
Thomas' father said he thought the report somewhat vindicated his son but he did not believe the Police Department had no intent to deceive the public.
"All of it was intended to make Kelly look bad ? every bit of it," Ron Thomas told reporters after the meeting. "They didn't have the facts there, and as it comes out now, it's not substantiated."

With environmental threats on the rise and more than 120 countries now in favor of reforming international environmental governance, conditions are right to create a new, specialized global environmental agency, says one of the world's leading scientists.
In a keynote address to government ministers meeting Tuesday in Kenya, Zakri Abdul Hamid, Science Advisor to the Prime Minister of Malaysia and former co-chair of the UN Millennium Ecosystem Assessment, says the world cannot afford the "overlapping mandates, funding requests and a lack of coordination and coherence," that characterizes today's "sprawling, decentralized regime" of global environment-related conventions and organizations.
Resources needed for effective program implementation are spent instead on administration, says Prof. Zakri.
"Besides making our limited resources work harder, we need to move beyond negotiating problem statements to capacity building and implementing solutions," he told the Ministerial Roundtable Discussion on the Institutional Framework for Sustainable Development, meeting at the Nairobi headquarters of the United Nations Environment Programme.
"We need better integration of science and policy in decision-making. We need to ensure that agendas set at the global level are not just abstract ideas at the local level, that we create resilient, resource efficient and prosperous communities treading lightly on the environment.
"We need transformative change."
Prof. Zakri noted that world leaders have "embraced and repeated the mantra that the status quo is not an option, that the time has come to act.
"At the end of each milestone global environmental event we declared: 'The planet is in peril and we must do something about it or humankind will be the ultimate losers. We agreed and formally recognized that, to address poverty, we have to address the environment and vice versa.'
"Today, however, we find ourselves far short of what's needed to relieve poverty and reverse environmental decline."
Options distilled from years of deliberation centre on strengthening the capacity of UNEP, a UN programme, or creating a new specialized agency for the environment -- "a locus for effective decision-making akin to world organizations governing common human interests in areas such as trade, health and nuclear technology."
Malaysias Prime Minister YAB Dato Sri Mohd Najib Tun Abdul Razak recently announced his country's endorsement of the latter, recognizing that "transformative change in international environmental governance transcends the North-South divide and requires global collective action," says Prof. Zakri. Others endorsing the idea include the entire membership of European Union, the African Union and many middle Asian countries.
"I want to underline that establishing a specialized agency does not mean establishing a watchdog for environment at the expense of economic development," says Prof Zakri. "The agency envisioned is a facilitator of environment-related coherence and cooperation. The focus is on helping member states, particularly developing countries and countries with economies in transition, to meet environmental commitments through their national development strategies."
Europe is expected to press for reform of environmental governance as a top priority when governments meet in June at the "Rio+20" conference in Brazil, convened to assess progress since the milestone 1992 Earth Summit, itself a 20th anniversary event marking the 1972 UN Stockholm Conference on the Human Environment.
Europe envisions a new agency with the same charter as UNEP but more money, more staff and more heft in the UN system. UNEP today, according to the European proposal, is "a body too low in the UN family to exert its influence."
Resistance to the idea has been expressed by some powerful countries including the US and Brazil, the latter concerned that economic progress in developing countries could be compromised.
Prof. Zakri, however, asserts that "reforming our system of governance will help improve our economic engine in ways essential to humanity's long-term interests, nurturing the robust, green economy towards which we all strive, one characterized by low carbon emissions, highly efficient use of resources, and a healthy, well-educated populace."
"When we celebrate the next anniversary of the landmark meeting in Stockholm, let's make sure we can say that we've done exactly that and instituted the transformative change required to reverse the trend of environmental degradation and improve human well-being."

The Giving Partner is set to publicly launch with a fast-paced 36-Hour Giving Challenge?during which more than $501,000 will be available to match online donations:

More than two thousand years ago, the Greek sage and philosopher Epictetus counseled, ?It is impossible for anyone to begin to learn what he thinks he already knows.?
Nowhere is this truer than in the stock market. You need only ask the many thousands of investors who have sat out an historic rally ? the market has doubled from its lows years ago ? because they just knew stock prices were only going to go lower.
That mindset has proved to be an expensive one. Yet these individuals now face another test.
If they jump into stocks today, having already missed one enormous move, they risk being in for the next leg down. That would hurt. On the other hand, if they continue to sit on the sidelines ? earning next to nothing in bonds or cash ? the market may well power higher and leave them with an even more extreme choice in the weeks and months ahead.
What is the prudent investor to do?
They Rise and They Fall
The first is to understand the error of your ways. Every market timer believes that if he sits patiently on the sidelines, he will get a better opportunity to buy stocks at lower prices.
And they often do. Unfortunately, they generally get to feeling so good about missing the downdraft that they convince themselves that the market will keep falling.
And, again, if often does. Until, of course, it doesn?t.
As the market climbs, they begin to rationalize that this is just ?a bear market rally? or ?a dead-cat bounce.? Until it becomes obvious that the train left the station and they?re still standing on the platform.
Cash is Not King, but Stocks Might Be
Warren Buffett?s mentor Benjamin Graham once said that no investor should have more than 75% of his money in stocks or less than 25%.
That?s a good rule of thumb. Seventy-five percent keeps you from getting overly enthused when times are good. And twenty-five percent keeps you from throwing in the towel when times are bad.
But what do you do now if you?re one of those who has played it too cautious until now and are fed up with your negative real returns in Treasury bonds or cash?
First, stop justifying what you?ve done and get off the dime. Start committing money to high-quality stocks in a gradual way. After all, if you shift a big percentage of your portfolio into stocks right now, you could regret it. And if you remain in cash, you could regret that, too.
So hedge yourself. Start moving money into stocks at regular intervals, being sure to keep buying if the market dips so you get better entry prices.
An Easy Way to Start Investing
A conservative place to start would be the Vanguard High Dividend Yield ETF (NYSE: VYM). True, it currently yields just 2.9%, but that?s still 50% more than 10-year Treasuries are paying and 50 times as much as the average money market fund.
Even if stocks go nowhere over the next 10 years ? highly unlikely given the decade we just had ? you?d still be better off in this fund than in a bond or money market fund.
There are a ton of reasons to put off making this move from the state of the economy to the size of the deficit. But that?s just the kind of thinking that got you stuck on the sidelines.
Look at the bright side. Inflation and interest rates are low. We?ve had five straight months of declines in the jobless rate. The ECB has extended three-year, low-cost loans to European banks. The Greek parliament has voted to actually cut spending. And we?re in a period of all-time record corporate profits.
So cast off. As the great nineteenth-century theologian William Shedd pointed out, ?A ship in harbor is safe, but that is not what ships are built for.?
